Waiver of Liability

WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND HOLD HARMLESS AGREEMENT

Please read this carefully. It affects the rights of you and/or your minor player (“Player”), if you or your minor player suffers any personal injury or death, or any loss or damage of personal property, while on any premises owned, leased, or otherwise operated by any facility for which HockeyCheckr.com has posted a Session or event listing, or for which HockeyCheckr.com has facilitated prepayment for a Session or event listing, as described below.

HockeyCheckr.com offers information regarding Hockey-related activities, which occur at locations that are not owned, supervised, or otherwise controlled by HockeyCheckr.com; The risk of injury from participating in ALL Hockey-related Activities are SUBSTANTIAL, including the potential for serious personal injury or death, and such risk of personal injury or death still exists despite any rules, training, supervision, equipment, or other precautions.

Player acknowledges and assumes the risk for all personal injury or death, or any loss or damage of personal property, resulting from or in any way related to participation in or spectating of theses Hockey-related Activities, or otherwise occurring on or at facilities that may or may not be associated with HockeyCheckr.com, including but not limited to if such personal injury or death, or loss or damage of personal property, is in any way related to the negligence of HockeyCheckr.com.

Player, on behalf of its self, and Player’s children, heirs, assigns, and next of kin, RELEASES AND FOREVER DISCHARGES HockeyCheckr.com and its respective Affiliates, officers, directors, shareholders, agents and volunteers (“Released Parties”), from any and all claims, demands or causes of action, whether now existing or arising in the future, on account of any personal injury or death, or any loss or damage of personal property, directly or indirectly resulting from or in any way related to participation in or spectating of any and all Hockey-related Activities, or otherwise occurring while on or en route to any facility that may or may not have a relationship with HockeyCheckr.com. This release shall apply even if such personal injury or death, or loss or damage of personal property, is in any way related to the negligence of HockeyCheckr.com, except to the extent arising from the gross negligence or willful misconduct of HockeyCheckr.com.

Player agrees and covenants that, neither Player nor any party claiming rights on behalf of or as a relationship to Player, will bring any suit or proceeding at law, in equity, or otherwise against the Released Parties on account of any personal injury or death, or any loss or damage of personal property, directly or indirectly resulting from or in any way related to participation in or spectating of the Hockey-related Activities, or otherwise occurring while on or en route to any facility that may or may not have a relationship with HockeyCheckr.com.

Player ACKNOLWEDGES and AGREES that: (a) Player has read the foregoing Waiver of Liability, Assumption of Risk, and Hold Harmless Agreement, understands it; (b) HockeyCheckr.com has made no representations, statements, or inducements, apart from the foregoing; (c) Player is at least 13 years of age, or the parent or legal guardian of the Player; and (d) this release is executed for full, adequate, and complete consideration.
